Maritime (Wet & Dry)

Our lawyers have a long and enviable reputation for dealing with all sorts of legal issues in these fields. Basically we distinguish the following areas of interest:

  • Air, Inland Waterways, Rail and Road Carriage
    Whatever the mode of transport we accept instructions from carriers and their liability insurers, or from shippers / consignees and their underwriters. We deal with cases where the Montreal and Warsaw Conventions apply (air law), the CMR Convention (road), the Hague and Hague-Visby Rules, and any of the general terms and conditions prevailing in the international carriage of goods over inland waterways.

  • Debt Collection / Ship Arrest 
    This can be promoted by effecting an attachment or arrest of goods belonging to the debtor. An attachment of bunkers or an arrest of a ship are possibilities here. The Netherlands have ratified the International Arrest Convention (done at Brussels on 10 May 1952). Consequently creditors may arrest either the particular ship in respect of which the maritime claim arose, or any other ship which is owned by the person who was, at the time when the maritime claim arose, the owner of the ship in question. An instruction to arrest a ship will be responded to immediately. Depending on the time of the day and the exact location of the vessel to be arrested it will take between 1.5 and 5 hours to effect the arrest. There is no need for a Power of Attorney to be executed and only in very rare cases will the Court order the creditor to out up a security to secure a potential claim for unlawful arrest.

  • Dry Shipping
    These cases pertain to P&I, FD&D and charterer's liability, cargo and H&M claims. The economic downturn is causing many charterers to default on charters and this has led to an increase of our work load. Our firm has assisted owners of vessels confronted by the sudden bankruptcy of EWL. We are particularly experienced in this type of distress work.

    We provide advice and litigation skills in connection with collision, salvage, wreck removal and pollution liabilities, and we assist our clients in dealing with interventions by local and state authorities and any media exposure that a case may attract.
